ROAE of 16.71% for the year and was achieved in spite of a $1,044,000
increase in FDIC insurance premiums in 2009. Malaga continues to have no

Net income for the fourth quarter was $2,364,000 ($0.41 per share basic
and fully diluted) compared to $1,930,000 ($0.34 per share basic and

Net income increased in 2009 primarily as a result of a $5,297,000
increase in net interest income due to a $57 million growth in average

revenue for the fourth quarter of 2009 reached $311.5 million, an

earnings per share for the quarter were 47 cents prior to the previously
announced settlement charges of 14 cents per share. Fourth quarter
diluted earnings per share, as reported, were 33 cents and included
charges for the proposed settlements and related legal costs, net of

company that Sensient acquired more than twenty years ago. The pre-tax

operating segment. Prior year fourth quarter diluted earnings per share

Without the fourth quarter charges of 14 cents per share, 2009 earnings
would have been $1.92 per share. For the twelve months ended December
31, 2009, Sensient’s reported diluted earnings per share, which include
the charges, were $1.78. Consolidated revenue for 2009 was $1.2 billion
compared to $1.3 billion in 2008.

For the twelve months ended December 31, 2009, foreign currency
translation reduced consolidated revenue and operating income by 4.3%
and 5.6%, respectively. In the fourth quarter of 2009, foreign currency
translation began to add to revenue and operating income as the U.S.
dollar weakened compared to its level in the prior year’s fourth
quarter. In the fourth quarter of 2009, foreign currency translation
added 5.5% and 5.3% to revenue and operating income, respectively.

Cash provided by operating activities for the twelve months ended

Subhani was hanged in 1985 after being convicted of spying for Israel and being an enemy of Islam — essentially the same charges that five Bahai men and two women are scheduled to be tried on Sunday in an Iranian court, Afnani said. They already have been in jail nearly two years. She and other Bahai leaders are holding a public forum and prayer vigil Sunday to coincide with the trial.

SAVANNAH, Ga. — Gavilon Fertilizer, LLC today announced plans to expand its fertilizer
operation in Sauget, Illinois. Construction of the 19,000-ton fertilizer
storage building is expected to be completed in the fall of 2010. Plans
also include the installation of high-speed bulk-fertilizer handling
equipment and rail configuration to accommodate the loading of 110-car
unit trains.

“We are pleased to be expanding and upgrading our fertilizer facility,”
commented Brian Harlander, president of Gavilon Fertilizer. “Upon
completion, Sauget will be the first bulk-fertilizer facility in the
United States capable of loading multiple products onto a single unit

shareholders was $0.62 per diluted share. Additionally, FFO for the
fourth quarter 2009, excluding the impairment of real estate, reflects
dilution of $0.34 per fully diluted share as a result of the 66.63
million shares issued in the June 2009 equity offering. FFO allocable to
common shareholders for the fourth quarter ended December 31, 2008, was
$52,867,000 or $0.80 per diluted share.

During the course of the Companys normal quarterly review, the Company
determined that it was appropriate to write down the depreciated book
value of three shopping centers to their estimated fair values. The Net
Operating Income (”NOI”) of the three centers represents less than 0.6%
of total 2009 portfolio NOI. These write downs resulted in a non-cash
impairment of real estate in the fourth quarter 2009 of $114,862,000.

higher-than-expected statutory and GAAP earnings volatility over the
past two years. Over the near term, Fitch expects PLCs earnings to
moderate relative to historical levels but be less volatile due to
increased hedging. Based on the companys increased financial leverage
and Fitchs reduced earnings expectations, GAAP EBIT-to-interest
coverage ratios are expected to decline to the 5-6 times range over the
near term, which is lower than historical levels.

Fitchs concern about higher-than-expected investment losses is driven
by PLCs above-average investment exposure to commercial real estate
(CRE) related assets, which consists of directly placed commercial
mortgage loans, commercial mortgage backed securities (CMBS), and equity

REDMOND, Wash. — Micronics, Inc. today announced that it has been issued a second letters
patent from the United States Patent and Trademark Office (USPTO) for an
integrated heat exchange system on a disposable, plastic cartridge. The
new patent has broad utility across the life sciences sector with
particular application in point of care molecular diagnostics.

The patent, entitled “System and method for heating, cooling and heat
cycling on a microfluidic device,” is U.S. Patent No. 7,648,835 (the
’835 case). The newly issued patent identifies the use of exothermic or
endothermic material in reservoirs that are contained within an
integrated disposable plastic cartridge. Once the chemical process of
the reservoir material is activated, the reservoir provides heating or
cooling to specific locations on the cartridge. Multiple reservoirs may
be included in a cartridge to provide varying temperatures. Micronics is
employing this technology in the development of disposable cartridges
for performance of a complete polymerase
chain reaction (PCR) temperature cycle in less than 15 seconds.

The ’835 case is related to an earlier patent, U.S. Patent No.
7,544,506, also issued to Micronics. The devices of these patents make
it possible to perform PCR or rtPCR in a fraction of the time of
commercial systems in use today. In Micronics’ molecular diagnostic
devices, all reagents required for a diagnostic test are incorporated

IN APRIL 2008, The Orange County Register published a bombshell of an investigation about a license plate program for California government workers and their families. Drivers of nearly I million cars and light trucks–out of a total 22 million vehicles registered statewide–were protected by a “shield” in the state records system between their license plate numbers and their home addresses. Not long ago, we pretty much knew what to expect from Mexican restaurants. Most menus were loaded with Tex-Mex enchiladas, tacos and nachos, all oozing with Cheddar cheese and scoops of sour cream. PRINCETON, N.J. — Long gone are the days when the average mobile phone user was content
with a built-in camera alone. According to a new study from ORC,
an Infogroup
company (NASDAQ: IUSA) one-fifth of Americans now own a multi-function
smartphone. Of the 29% of Americans who currently own the device or have
plans to purchase one in the coming year, the top three “must have
features” were cited as follows: e-mail (85%), Internet browser (78%)
and digital camera (73%). GPS appears to be a differentiator that might
bring additional consumers to the smartphone market, with 73% of
smartphone intenders listing this as a “must have” (compared to only 55%
of early adopters).

In addition to specific features of the phone itself, seven in ten (72%)
respondents are looking for a fast 3G or 4G network. Awareness of the
latest 4G network is still building among those not already using a
smartphone (41%), and among smartphone users who would already be
equipped to take advantage of the increased bandwidth, awareness is
nearly doubled at 81%.

“While having a smartphone with lots of features is certainly an

IN APRIL 2008, The Orange County Register published a bombshell of an investigation about a license plate program for California government workers and their families. Drivers of nearly I million cars and light trucks–out of a total 22 million vehicles registered statewide–were protected by a “shield” in the state records system between their license plate numbers and their home addresses. There were, the newspaper found, great practical benefits to this secrecy. “Vehicles with protected license plates can run through dozens of intersections controlled by red light cameras with impunity,” the Registers Jennifer Muir reported. “Parking citations issued to vehicles with protected plates are often dismissed because the process necessary to pierce the shield is too cumbersome. Some patrol officers let drivers with protected plates off with a warning because the plates signal that drivers are one of their own or related to someone who is.” The plate program started in 1978 with the seemingly unobjectionable purpose of protecting the personal addresses of officials who deal directly with criminals. Police argued that the bad guys could call the Department of Motor Vehicles (DMV), get addresses for officers, and use the information to harm them or their family members. There was no rash of such incidents, only the possibility that they could take place. So police and their families were granted confidentiality. Then the program expanded from one set of government workers to another. Eventually parole officers, retired parking enforcers, DMV desk clerks, county supervisors, social workers, and other categories of employees from 1,800 state agencies were given the special protections too. Meanwhile, the original intent of the shield had become obsolete: The DMV long ago abandoned the practice of giving out personal information about any driver. What was left was not a protection but a perk. Yes, rank has its privileges, and its clear that government workers have a rank above the rest of us. Ordinarily, if one out of every 22 California drivers had a license to drive any way he chose, there would be demands for more police power to protect Californians from the potential carnage. In the Notice Letter, Teva alleges that three patents associated with
tenofovir disoproxil – U.S. Patent Numbers 5,922,695; 5,977,089; and
6,043,230; and one patent associated with tenofovir disoproxil fumarate
– U.S. Patent Number 5,935,946 – owned by Gilead Sciences are invalid,
unenforceable and/or will not be infringed by Teva’s manufacture, use or
sale of the product described in its ANDA submission.

Gilead is currently reviewing the Notice Letter and has 45 days from the
date of receipt to commence a patent infringement lawsuit against Teva.
Such a lawsuit would restrict the FDA from approving Teva’s ANDA for up
to 30 months or until a district court decision that is adverse to
Gilead, whichever occurs first.

Viread is currently protected by four patents, which are listed in the
FDA’s Approved Drug Products List, and all four patents would need to be
invalidated or expired before a generic version of Viread could be
marketed. The U.S. Patent Trademark Office (PTO) confirmed the
patentability of these four Viread patents in 2008.

Gilead currently has a lawsuit pending against Teva in response to
Teva’s attempts to seek approval for generic versions of Truvada®
(emtricitabine and tenofovir disoproxil fumarate) and Atripla®
(efavirenz 600 mg/emtricitabine 200 mg/tenofovir disoproxil fumarate 300
mg) based on allegations that two emtricitabine patents are invalid,
unenforceable and/or will not be infringed by Teva’s manufacture, use or

ACCORDING TO THE conventional wisdom, the United States faces a massive medical bill thanks to our use of pricey new treatments and equipment. “About half of all growth in health care spending in the past several decades was associated with changes in medical care made possible by advances in technology,” a 2008 Congressional Budget Office report declared. “Health care economists attribute about 50 percent of the annual increase of health costs to new technologies or to the intensified use of old ones,” the bioethicist Daniel Callahan writes in his new book Taming the Beloved Beast: How Medical Technology Costs Are Destroying Our Health Care System. This is familiar territory for Callahan, who for decades has advocated reining in medical innovation to reduce health care costs. He also favors limiting the life-extending treatments that older people receive, on the grounds that most of them will “have lived a full and fruitful biographical life prior to age 70.” Interestingly, Callahan, age 79, underwent a life-saving seven-hour heart procedure in August that cost upward of $100,000. In his new book, Callahan complains that “American health care is radically American: individualistic, scientifically ambitious, market intoxicated, suspicious of government, and profit-driven.” Hes right at least about our high-tech vitality: The U.S. does develop and deploy medical innovations much faster than other rich countries. New pharmaceutical products generally hit the market here two years earlier than elsewhere, according to a December 2008 report from the business consultancy McKinsey, which also blames high-tech medicine for escalating costs. The McKinsey report further notes that American physicians are “much quicker to adopt new surgical techniques and advances in anesthesia.” The top five U.S. hospitals alone conduct more clinical trials than any other single developed country. But is high tech medicine really to blame for rising health care costs? Last June Columbia economist Frank Lichtenberg published a study that suggests the opposite. Advanced medical technologies, Lichtenberg suggests, are not contributing to rising American health care expenditures because the money they save makes up for the money spent on them. Lichtenberg begins by looking at how the rate of increase in longevity has varied among U.S. states between 1991 and 2004. He investigates how such factors as the quality of medical care, behavioral risks, education, income, and insurance coverage affect life expectancy. To measure differences in the quality of medical care, he examines how quickly each state took up advanced medical diagnostics and new drugs. He also calculates what fraction of physicians in each state was trained at top-ranked medical schools.

PROGRESSIVES AND libertarians dont agree on much these days, but they are coming together on one point: The Ninth Amendment to the U.S. Constitution tastes great and is less filling. In his 2007 book Retained by the People, the Berkeley law professor Daniel Farber described vistas of positive rights–from tenant protections to state-funded education to rights drawn from multinational conventions and overseas courts–that could open if Americans “embrace their heritage of support for human rights and join the rest of the world in the effort to articulate those rights.” The amendments libertarian fans are no less enthusiastic. The Georgetown law professor (and reason contributor) Randy Barnett has argued that the Ninth Amendment should be a guide to the Framers thinking on rights retained by individuals. A “conservative” estimate by the House Ways and Means Committee in 1966 projected that Medicare would cost $12 billion after inflation by 1990. The actual 1990 cost was nearly nine times more: $107 billion. Today Medicare costs $408 billion, consuming about 13 percent of the total federal budget. Since 1993 projections about Medicares eventual date of bankruptcy have oscillated considerably. In 1997 the Medicare Trustees projected that its hospital fund would be depleted by the middle of 2000. Fiscal collapse was avoided when the Balanced Budget Act of 1997 imposed what amounted to price controls on physicians and hospitals. As a consequence, in 2000 the Medicare Trustees sunnily projected that the program would be solvent through 2029. Nine years later, the latest Medicare Trustees report projects that the hospital fund (Part A) will be depleted by 2017. The trustees assert that bringing it into actuarial balance during the next 75 years will require either immediately raising the Medicare payroll tax from 2.9 percent to 6.78 percent or cutting current benefits by 53 percent. Medicare Part B, which pays for outpatient care and doctor bills, and the recently added Part D, which pays for prescription drugs, are “both projected to remain adequately financed into the indefinite future because current law automatically provides financing each year to meet next years expected costs.” Translation: About 75 percent of Medicare funds spent on doctors and drugs come from general tax revenue.
IN APRIL 2008, The Orange County Register published a bombshell of an investigation about a license plate program for California government workers and their families. Drivers of nearly I million cars and light trucks–out of a total 22 million vehicles registered statewide–were protected by a “shield” in the state records system between their license plate numbers and their home addresses. There were, the newspaper found, great practical benefits to this secrecy. “Vehicles with protected license plates can run through dozens of intersections controlled by red light cameras with impunity,” the Registers Jennifer Muir reported. “Parking citations issued to vehicles with protected plates are often dismissed because the process necessary to pierce the shield is too cumbersome. Some patrol officers let drivers with protected plates off with a warning because the plates signal that drivers are one of their own or related to someone who is.” The plate program started in 1978 with the seemingly unobjectionable purpose of protecting the personal addresses of officials who deal directly with criminals. Police argued that the bad guys could call the Department of Motor Vehicles (DMV), get addresses for officers, and use the information to harm them or their family members. There was no rash of such incidents, only the possibility that they could take place. So police and their families were granted confidentiality. Then the program expanded from one set of government workers to another. Eventually parole officers, retired parking enforcers, DMV desk clerks, county supervisors, social workers, and other categories of employees from 1,800 state agencies were given the special protections too. Meanwhile, the original intent of the shield had become obsolete: The DMV long ago abandoned the practice of giving out personal information about any driver. What was left was not a protection but a perk. Yes, rank has its privileges, and its clear that government workers have a rank above the rest of us. Ordinarily, if one out of every 22 California drivers had a license to drive any way he chose, there would be demands for more police power to protect Californians from the potential carnage. But until the newspaper series, law enforcement officials and legislators had remained mum. The reason, of course, is that the scofflaws are law enforcement officials and legislators.

Isha Wins $100,000 in Chase Community Giving/Facebook Competition
to Help Build a School for Rural Children in Southern India and Medical
Facility in Tennessee

MCMINNVILLE, Tenn. — On Thursday night, people from all over Southern India rallied to bring
out the vote for Isha Foundation’s race to win the Chase Community
Giving charity contest hosted on line by Facebook. The Isha Foundation,
an international non-profit humanitarian social organization with U.S.
headquarters in middle-Tennessee and international headquarters in Tamil
Nadu, India worked tirelessly to win the coveted $1mm first place prize.
Ishas expected winnings were earmarked to build a school in rural India
and a health care clinic in Tennessee. Placing second by a mere 1200
votes has won them $100,000 towards their objective. “Even though we are
disappointed to lose the $1 million which would have made a huge
difference for thousands of disadvantaged children in India and patients
in Tennessee,” Isha Foundation President, Dr. Kalpana Rajdev began, “we
are excited to win $100,000 which will still help us do so much.”

While the U.S. offices worked round the clock, volunteers in India,
mobilized tens of thousands of supporters to vote at computer stations
in more than 60 schools and universities. Homemakers, laborers,
villagers and students came together to vote to support Isha
constructing a new school for the rural children in their area. Even
through the night, voting kiosks were opened in remote areas where
people, who never had the opportunity to use a computer, were able to
vote online to break their cycle of poverty for the next generation. The

In the early 1990s, Washington imposed a crushing trade embargo to bring about democratization — specifically, the reinstatement of democratically elected President Jean-Bertrand Aristide. The embargo destroyed Haitis fragile manufacturing industries. Then, true to Americas political swings, ideologues in the Bush administration spent years trying to oust Aristide, first by foisting a de facto and illegal aid freeze on international development agencies, and then by brazenly toppling Aristide and carrying him to the Central African Republic. Congress took a pass on reviewing these sordid events, pausing only to declare its love for the Haitian people.

THE TERM “animal shelter” commonly denotes a temporary place to house animals in transition. While most prospective pet adoptees are in the shelter for fewer than two or three months, others remain for much longer periods of time. Such was the case with REYNA. When she healed and was ready for adoption, she was placed in the first kennel as one enters the alley and became the greeter for all in Dog Alley. The volunteers loved to walk her and play in the yard with her, as she was affectionate and seemed deeply grateful for every minute of human interaction. A brindle pit bull mix, Reyna was overlooked by adopters for more than a year. Last week, a family came in to the shelter on a mission for a family dog. They met Reyna and fell in love with her, adopted her and made her a part of their family, even surrendering their back yard to her while allowing her total access to the home. This is indeed a very special happy ending for all those who love Reyna. There were five other adoptions last week, as well. SNOWFLAKE, a gorgeous white female bunny, arrived at the shelter many months ago and was noted to have abnormalities in the lower abdomen. Upon examination by a vet, it was determined she had been abused by humans, possibly having been picked up by the tail and twirled, causing herniation, displacement of her lower bowel and surrounding tissue and other injuries, including the loss of her tail.

THE House and Senate have now each passed a health-care bill. It remains to be seen whether they can agree to pass the same one, especially since their negotiations will take place amid public hostility to the entire enterprise. The Senate bill is likely to provide the template for the negotiations. To the dismay of the Left, it lacks a new government-run insurer. Instead it imposes on the industry a new business model that could never survive in a free market and makes up for the imposition by forcing Americans to buy its products. As far as we can tell, the only reason to carry out this maneuver is to have an industry that can be called “private” while actually acting as an agency of the government. The industrys products will be more expensive, and its profits pure waste. Both bills expand Medicaid, ensuring that many Americans–some of whom lack health insurance and some of whom have good insurance–will now have low-quality insurance that many doctors refuse to take. They will also cut Medicare, crippling its popular private-sector elements and inducing doctors and hospitals to turn down Medicare patients, too. One of the Mayo clinics, touted by President Obama as a model for reform, has announced already that it will not be accepting Medicare payments because it does not want to accept Medicare price controls. Both bills include mandates on employers that are guaranteed to reduce hiring, wages, or both. Scores of House Democrats have pledged to vote down any bill that lacks a government-run insurer. We will now see whether they are as good as their word or their threats are empty. Pro-life Democrats in the House may also be tested, since the Senate bill provides federal funding to help people buy abortion coverage.

SALT LAKE CITY — As Salvia Miramontes inspects the damage in her home, her couch and other pieces of furniture are loaded into a trailer to be taken to the dump. Carpet. A couch. Clothes. Beanbag chairs. Anything with fabric. All of it had to be thrown out because it was contaminated with chemical residue from tear gas that police deployed inside the home. On Jan. 5, SWAT teams from several jurisdictions converged on Miramontes home. Investigators were looking for one of her relatives, Roberto Miramontes, 37, who police believe had shot and killed Millard County sheriffs deputy Josie Greathouse Fox several hours earlier.

Nurses improve medication administration accuracy The study involved the implementation of the Integrated Nurse Leadership Program (INLP), which provides frontline nurses and other hospital staff with training, resources, and authority to devise and implement solutions. In addition to showing the importance of empowering frontline nurses, the most significant finding of the study is that “significant improvement in outcomes can be accomplished without very expensive fixes,” says Julie Kliger, MPA, BSN, RN, INLP creator and program director at the Center for the Health Professions, University of California, San Francisco; principal and founder of The Altos Group; and lead author of the article. “Thats important because there are a lot of financial and resource pressures today, and people sometimes think they need to spend millions for bar-coding; this demonstrates through almost old-fashioned QI and engaging the people who are doing the work and providing them with tools, skills, and resources, that they can make statistically significant improvement.”
WESTPORT, Conn. — Inspired by the news of Haitian earthquake survivors located by canines
trained by the Search
Dog Foundation (SDF), Ms. Joanne Woodward Newman and Newman’s
Own Foundation today announced a combined $100,000 challenge grant
in support of SDF’s teams.

“Time is of the essence in locating survivors buried in the rubble of
this devastating disaster,” said Bob Forrester, president and CEO of Newman’s
Own Foundation. “SDF teams are critical to Haiti’s search-and-rescue
efforts. Please join us in supporting their life-saving work.”

The Search
Dog Foundation is the only non-profit in the nation that recruits
rescued dogs, partners them with firefighters, and trains them to find
survivors buried in the wreckage of disasters. The teams and their
ongoing training are provided at no cost to Fire Departments throughout
the country.

“I am shocked and saddened by the human suffering we are witnessing in
Haiti,” said Woodward Newman. “Finding survivors must be a first
priority and supporting SDF will help save lives.”

Last Friday, an SDF-trained search team — serving as part of California
Task Force 2 — found three girls trapped alive since Tuesday in
Port-au-Prince. Bill Monahan and his Border Collie Hunter were searching
a neighborhood near the Presidential Palace, when Hunter “bark alerted”
the survivors’ location in the crumbled remains of a four-story building.
